CHIP'd, Inc., a California corporation ("CHIP'd," "we," "us," or "our"), values your privacy and takes it seriously. This Privacy Policy ("Policy") describes how we collect, use, and disclose information about visitors to our CHIP'd website located at https://chipd.io/ or the DRLZ website located at https://www.drlz.io/ (collectively, the "Websites"), and users of the services available through the Websites, our mobile application, and any other digital platforms we operate (collectively, the "Services").
By visiting the Websites or using any of the Services (including through third-party applications), you agree that your personal information will be handled as described in this Policy. Your use of the Websites or Services, and any dispute regarding privacy, is subject to this Policy and our Terms and Conditions, including applicable limitations on damages and provisions governing dispute resolution.
For purposes of this Policy, "personal information" means information that identifies, relates to, or can reasonably be linked to you, as well as any information protected as personal information under applicable laws. This Policy does not apply to third-party websites you may visit before reaching our Websites or to third-party sites that may be accessible through the Services.
1. The Information We Collect About You
We collect information about you in three ways: (1) directly from you, (2) from third parties, and (3) automatically through your use of the Websites or Services.
Information We Collect Directly From You
You may browse certain areas of the Websites without registering with us or providing us personal information. If you register for our Services as a customer, then you must provide your name, email, phone number and contact details. In addition, if you use our Services to make a purchase, you may be asked to provide payment and billing information, including credit card information and billing addresses. Credit cards are processed by our third-party credit card processor which complies with the Payment Card Industry Data Security Standard (PCI-DSS). Billing and information may be shared with third-party vendors that we retain to ship any products you order from us.
In addition, if you are providing personal information for third parties such as your spouse or partner in connection with using our Services, you are responsible for ensuring that you have all required permissions and consents to provide such personal information to us for use in connection with the Services and that our use of such personal information to provide the Services does not violate any applicable law, rule, regulation or order.
Information We Collect Automatically
We may automatically collect the following information about your use of our Websites or Services through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Websites or use our Services; and the referring URL, or the webpage that led you to our Websites. We may combine this information with other information that we have collected about you, including, where applicable, your user name, name, and other personal information. 2. How We Use Your Information
We use your information, including personal information, for the following purposes:
- Provide Our Services. We use your information to communicate with you about your use of our Websites and Services, to provide our Websites and Services, to respond to your inquiries, and for other customer service purposes.
- Provide Personalized Services. We use your information to tailor the content and information that we may send or display to you, to offer location customization and personalized help and instructions, and to otherwise personalize your experiences while using the Websites and Services.
- Improve and Develop Our Services. We use your information to ensure our Websites and Services are working as intended, to better understand how users access and use our Websites and Services, both on an aggregated and individualized basis, to make improvements to our services, to develop new Services, and for other research and analytical purposes.

For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you to assist us in advertising our Services on third-party websites.
- Comply With Legal Obligations, Prevent Fraud, and Protect Rights or Property. We use your information as necessary to comply with our legal obligations, respond to law enforcement inquiries, comply with legal process (e.g., warrant, subpoena, civil discovery or investigative demand), to enforce or defend legal claims, prevent fraud and protect the security of our systems, prevent injury or damage, and protect our rights or property or the rights or property of others. Because CHIP'd does not provide medical, therapeutic, or health-related services, no data you share with us is subject to any medical or provider-patient privilege. Additionally, if we believe that there is a potential threat to the safety of any person they may provide this information to law enforcement agencies in accordance with applicable law.
3. How We Share Your Information
We may share your information, including personal information, as follows:
- Consent. Where you have provided consent, we share your information, including personal information, as described at the time of consent, such as when you authorize a third-party application or website to access your CHIP'd account or when you participate in promotional activities conducted by CHIP'd partners or third parties. You can withdraw your consent at any time by contacting us at support@chipdsports.com.
- Affiliates. We may disclose the information we collect from you to our affiliates or subsidiaries solely for the purpose of providing Services to you; however, if we do so, their use and disclosure of your personally identifiable information will be maintained by such affiliates and subsidiaries in accordance with this Policy.
- Service Providers. We may disclose the information we collect from you to third-party vendors, service providers, contractors or agents who perform functions on our behalf.
- Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another entity in connection with a transaction or as part of a bankruptcy proceeding, or are in negotiations for any of these types of transactions, we may transfer the information we have collected from you to the other company or entity.
- In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a subpoena.
- To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms and Conditions or this Policy, or as evidence in litigation in which we are involved.
- Aggregate and De-Identified Information. We may share aggregate, anonymized or de-identified information about users and their use of the Services with third parties and publicly for marketing, advertising, research or similar purposes. Please note that except as noted above, we will not sell or share your personal information with any third party for their direct marketing purposes without your consent.
4. Our Use of Cookies and Other Tracking Mechanisms
We and our service providers use cookies and other tracking mechanisms to track information about your use of our Websites and Services. We may combine this information with other personal information we collect from you (and our third-party service providers may do so on our behalf). Currently, our systems do not recognize browser "do-not-track" requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies), but such disabling will impair use of the Websites and Services.
Cookies
Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Websites and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Websites and Services. There are two types of cookies: session and persistent cookies.
Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Website. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Websites.
Disabling Cookies
Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Websites who disable cookies will not be able to browse certain areas of the Websites or use the Services.
Third Party Analytics
We use automated devices and applications, such as Google Analytics, to evaluate usage of our Websites and our Services. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.
Third-Party Links
Our Websites and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.
5. Security of Your Personal Information
We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse and unauthorized access, disclosure, alteration, and destruction.
Please be aware that despite our efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
6. Do You Sell My Personal Information?
We do not sell your personal information for monetary or other valuable consideration, as those terms are defined under applicable California law. If you have questions regarding your opt-out rights or our data-handling practices, please contact us at support@chipdsports.com.
7. What Rights Do I Have Regarding My Personal Information?
You may request access to, a copy of, or the correction or deletion of personal information that you have provided to us by contacting support@chipdsports.com. We will use reasonable efforts to comply with such requests as required by law. However, we may need to retain certain information to comply with legal obligations, maintain accurate business and financial records, or for other legitimate business purposes. We may also request additional information to verify your identity before processing your request. Please note that updated or deleted information may continue to appear in cached or archived copies of the Websites for a period of time.
8. What Choices Do I Have Regarding Use of My Personal Information for Marketing?
We may send you promotional or informational emails from time to time. You may opt out of marketing communications by following the unsubscribe instructions included in each email. Please allow up to ten (10) business days for us to process your request. Even if you opt out of marketing emails, we may still send you transactional or service-related communications about your account or the Services you use.
9. Location of Information
Our Websites and Services are operated from the United States and are intended for use within the United States. We store all information we collect in the United States. If you access the Websites or Services from outside the United States, you acknowledge and agree that your information will be transferred to, stored in, and processed in the United States, which may provide different levels of data protection than your country of residence.
10. Children and Minors
The Websites and Services are intended for individuals who are 18 years of age or older, or for those under 18 who use the Services only with the consent and direct supervision of a parent or legal guardian. We do not knowingly collect personal information from children under 13, and we request that users do not provide personal information about minors unless necessary and only with appropriate consent. If we learn that an unsupervised minor under 18 has provided us with personal information, or that personal information about a minor was provided without proper consent, we will delete such information from our systems. 11. Changes to This Policy
This Policy is current as of the Effective Date listed above. We may update or modify this Policy from time to time. Any changes will be posted on the Websites, and the Effective Date will be updated accordingly. If we make material changes that affect how we handle personal information previously collected from you, we will endeavor to provide advance notice—such as by highlighting the changes on the Websites or by emailing you at the address associated with your account. Please keep your account information up to date so that you receive such notices.
12. California Privacy Notice
We are not currently subject to the California Consumer Privacy Act ("CCPA"), but we will update this Policy if and when we become subject to it. Until then, please refer to the section titled "What Rights Do I Have Regarding My Personal Information" for details on how to request access to, or deletion or modification of, the personal information we collect.
Additionally, under California Civil Code §1798.83, California residents who have provided personal information to CHIP'd may request information regarding our disclosures, if any, of personal information to third parties for their direct marketing purposes. Such requests must be submitted to support@chipdsports.com. Within 30 days of receiving a qualifying request, we will provide a California Privacy Disclosure identifying the categories of personal information disclosed during the prior calendar year for direct marketing purposes and the names and addresses of the third parties that received such information. Requests may be submitted no more than once per calendar year.
13. GDPR Notice
The Services are intended for use within the United States and are not directed to individuals located in the European Union ("EU") or the European Economic Area ("EEA"). CHIP'd does not intentionally market, offer, or provide the Services to individuals in the EU or EEA and does not knowingly collect personal information from such individuals. If you are located in the EU or EEA, you should not use the Websites or Services. If we learn that we have inadvertently collected personal information from an individual in the EU or EEA, we will delete such information from our systems.
